This text has been drawn up in accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation and is a public offer containing all the essential terms of the sale and purchase agreement or the provision of services. Please read the terms of this offer carefully. By using the service, placing an order and paying for the goods, you confirm that you have read and agree with all the terms of this offer without exception.

This public offer (hereinafter referred to as the Offer) is addressed to any persons wishing to purchase goods from Individual Entrepreneur Semyon Eduardovich Gavrilov and is his proposal to conclude an agreement for the sale and purchase of digital goods or the provision of services on the terms set out in the Offer, in accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation. In accordance with Article 437 of the Civil Code of the Russian Federation, this offer shall be deemed accepted from the moment an individual performs the actions stipulated by the offer and signifying the unconditional acceptance by the individual of all the terms of the offer without any exceptions or restrictions, on the terms of accession. The public offer regulates the terms of purchase, use of the product, the rights and obligations of the Parties, etc. Before purchasing the product, individuals must familiarize themselves with its terms.

1. Terms and Definitions

1.1. Public Offer - this document, a public offer of the Seller addressed to all persons wishing to purchase the offered digital product, to conclude an agreement with it for the sale and purchase of digital products (hereinafter referred to as the «Agreement») on the terms and conditions contained in the Offer located on the Website at: http://proxysoxy.com/

1.2. An order is a list of one or more items (positions) of the Seller's goods, containing information about the quantity of the Seller's goods and their type. It is carried out by the Buyer selecting the goods he or she wishes to purchase by clicking a specific button on the Website. Placing an Order indicates the intention to purchase a digital product or service.

1.3. Acceptance is the Buyer's full and unconditional acceptance of all points of the Offer. Acceptance is one of the following actions: replenishing the balance on the Website, registering a Personal Account, placing an Order, the fact that the Buyer has paid the full cost of the goods by debiting funds from a bank account or the balance of the Personal Account or any other method available in the Service. From the moment the Buyer accepts the Offer, the Agreement is considered concluded.

1.4. User/Buyer is an individual or a legal entity who wishes to purchase or has purchased a digital product from the Seller.

1.5. Seller - Sole proprietor Gavrilov Semyon Eduardovich, conducting his business and sales through his own website located on the Internet at: http://proxysoxy.com/.

1.6. Website - a website belonging to the Contractor, located on the Internet under the domain name (domain, address) - http://proxysoxy.com/, as well as derivative web pages included in it, ensuring interaction between the Seller and the User. The Website is used by the Seller to sell, transfer goods, provide services to Users; it is a system for posting information about the goods sold, communicating it to Buyers, processing applications and selling goods. Within the framework of this Offer, the concepts of «Site», «Service» and «Store» are equivalent and are interpreted authentically in the context of the Offer.

1.7. Digital product – the object of the agreement between the Seller and the Buyer, the list of product names, characteristics / subject and methods of provision of which are described by the Seller on the Website, and are displayed to the Buyer before the Order is placed.

1.8. Proxy server – an intermediate server acting as an intermediary between the User and the target platform, in order to redirect requests, hiding the IP address and geolocation of the User.

Proxy output format – a file containing information in the form [login]:[password]@[ip]:[port] or in another form that allows the use of the received product.

1.9. Personal account – the User’s personal section, located on the website at: http://proxysoxy.com/, accessible only to the User.

2. Using the Site

2.1. On the Site, the User can use the Personal Account, place Orders, access services and products, send requests to the support service, resolve technical issues and use other options of the Site.

After the User registers on the Site, a unique personal account is created in which the User can select an Order for payment, as well as access the services and products provided.

2.2. The User is obliged to maintain the confidentiality of their login data for their Personal Account on the Site. If the User believes that someone has gained unauthorized access to such data, they are obliged to immediately report this. All actions performed on the Site by a person authorized using the user's login data will be considered to have been performed by them, unless otherwise proven by acts, decisions and sentences of state bodies. The User will bear responsibility and any negative consequences for such actions.

2.3. The Seller does not disclose information about users to third parties, except in cases provided by law (for example, at the request of certain government agencies).

3. Subject, price, quantity

3.1. The subject of the offer is the sale of digital goods and (or) the provision of services. After receiving acceptance, the Seller transfers, and the Buyer accepts and pays for the goods (services) on the terms and conditions specified in this Offer.

3.2. The specific name, quantity and cost of the Goods are determined by the Seller unilaterally and indisputably and are indicated on the Website located at http://proxysoxy.com/. The Buyer has the right to choose the quantity and type of goods from among the proposed options.

3.3. The price of the goods is indicated in rubles of the Russian Federation.

4. Acceptance of the Offer

4.1. The Buyer shall accept the provisions of this Offer by performing the implicative actions specified in clause 4.3. of the Offer (acceptance of the offer). The Buyer's acceptance of the Offer is voluntary and means the Buyer's full and unconditional acceptance of all the terms of the Offer without any exceptions and (or) restrictions.

4.2. Before accepting the Offer, the Buyer must be sure that he understands all the terms of the Offer and accepts them unconditionally and in full.

4.3. The Buyer shall accept the Offer by performing one of the following actions: replenishing the balance on the Website, registering a Personal Account, placing an Order, the fact of payment by the Buyer of the full cost of the goods by debiting funds from a bank account or the balance of the Personal Account or any other method available in the Service.

5. Replenishing the balance and the procedure for placing an Order

5.1. The balance on the Site can be replenished by depositing funds through any of the replenishment methods provided on the Site.

5.2. To place an Order, the Buyer must select the desired product for purchase and its quantity.

5.3. Payment for the Order is made by the Buyer placing an Order on the Site and then paying for it by confirming the debiting of funds from the bot balance by clicking the «Buy» or «Pay» button.

5.4. Payment for the Order can be made without replenishing the Site balance by using third-party payment systems, if such a function is provided on the Site.

6. Procedure for the transfer and acceptance of goods

6.1. After the payment for the Order, the Buyer will be able to download a file with data for using the proxy server in the Orders section of the Personal Account.

All proxies are provided in the format [login]:[password]@[ip]:[port] or in another form that allows using the received product.

6.2. The product is issued immediately after the transaction is processed and the Seller receives payment.

6.3. The Seller's obligation to sell the product is considered fulfilled at the moment the product and (or) access to the product are transferred to the Buyer.

7. Warranties, procedure for receiving a replacement product, returns

7.1. The warranty for proxy performance is one month from the date of issue, unless otherwise specified in the description of the Product.

7.2. Proxy performance is an indicator of the overall performance of the server, which can be assessed by the following factors: speed, availability, ping, level of anonymity, proxy type, geo. If the majority of checks indicate that the proxy is working, then such a proxy is considered working.

Proxy performance means that they fulfill their purpose - the function of an intermediary between the network user (User) and the server to which you need to connect.

7.3. If the proxy stops working before the warranty expires, the User can contact the Service's technical support to submit a replacement request.

After the Seller checks the proxy for operability and makes a decision to replace the proxy, the User is issued a new proxy.

The warranty period for the new proxy is reduced by the days of operability of the replaced product due to the product's features. If the proxy stops working on the 25th day, the warranty period for the new product will be the difference between the number of days in the month and the days of operability of the replaced proxy, i.e. 5 days.

7.4. The User must understand that due to the product's features, the Seller does not and cannot guarantee the operation of specific sites when using purchased proxies. Third-party websites may restrict access to their network resources for various reasons (e.g. proxy geolocation, digital footprint on the User's device, etc.) that the Seller has no objective ability to influence.

If, when checking the proxy's operability upon request submitted in accordance with clause 7.3. of this Offer, the Seller finds that the proxy fulfills its primary purpose when using the websites, then such a proxy is considered operational.

The inaccessibility of the website required by the User through the proxy does not mean that the product is inoperative. Such a case is not subject to replacement under warranty.

To avoid such situations, the Seller recommends exercising its right specified in clause 8.1.7 of this Offer or purchasing a small number of proxies to test their operability in relation to a specific website of interest to the Buyer.

7.5. The inoperability of a proxy through certain software is not considered a warranty case. Different programs may not support certain proxy formats. The proxy format is known to the User in advance, which allows him to study in advance the possibility of the program he uses working with the specified proxy format (see Section 1 «Terms and Definitions» or clause 5.1 of this Offer).

7.6. Exchange and replacement of goods in the event of non-compliance of the goods with the subjective assessment of the Buyer or technical compliance with the Buyer's expectations within the framework of this Offer are not provided for due to the specific features of the goods.

Purchased proxies are issued to a limited number of users to ensure the fulfillment of the main purpose and functions of the goods.

In order to avoid controversial situations, the Buyer is advised to contact technical support for information on the operability of the proxy in relation to specific sites, for information on proxy types and on other issues.

8. Rights and Obligations of the Parties

8.1. The Buyer has the right to:

8.1.1. Independently decide to purchase the goods from the Seller by fully and unconditionally accepting the Offer.

8.1.2. Receive information about the goods available from the Seller and other information regarding the goods offered for purchase by the Seller from product descriptions on the Website or open sources.

8.1.3. Receive the goods subject to timely payment and compliance with this Offer.

8.1.4. Top up the balance of the Personal Account in the way available on the Website.

8.1.5. Pay for the order in any way provided in the Service, i.e. using third-party payment systems.

8.1.6. Change the format of the goods by using the symbol replacement function in a text document or other methods. It is possible to change the format only to the one that contains all the data issued after the purchase.

8.1.7. Check with the Seller's technical support about the operability of the proxy in relation to a specific site if the Buyer purchases a proxy to conduct business in relation to a previously known site.

8.2. The Buyer is obliged to:

8.2.1. Read in detail all the points of this Offer, with a description of the goods desired for purchase on the Site and accept them before purchasing the goods, as well as all additional rules governing the relationship between the Parties.

8.2.2. Follow the rules of polite communication. In particular, the Buyer undertakes to avoid flooding, swearing, insults, impolite communication, misleading, deception, slander, spam in communication with the Seller.

8.2.4. Pay the full cost of the goods.

8.2.5. Not to post, publish, transmit or distribute knowingly false messages that may be criminal in nature or cause any harm to the Seller or its activities.

8.2.6. Comply with all procedures for placing an Order according to the rules set out in the Offer and on the Website.

8.2.7. Ensure that third parties are unable to use your Personal Account on the Website.

8.3. The Seller has the right to:

8.3.1. Require the Buyer to comply with all procedures for placing an Order, applying for and paying for the goods according to the rules set out in the Offer and on the Website.

8.3.2. If the Buyer refuses to accept the Offer in full, refuse to sell the goods to the Buyer.

8.3.3. Set and change prices for their products, their quantities unilaterally and at any time.

8.3.4. Require the Buyer to pay for the product in full before selling and issuing the product.

8.3.5. If the Buyer fails to comply with any of the terms of the Offer, refuse to provide services, sell the product, including support.

8.3.6. Use the Service to send advertising mailings.

8.3.7. Transfer the User's data to law enforcement agencies if there is information about the use of the Product for criminal activity.

9. Liability of the Parties

9.1. The Seller shall not be liable for the discrepancy between the product and the Buyer's expectations and/or its subjective assessment, technical compliance with the Buyer's expectations.

9.2. The Seller shall not be liable for the inability to service the Buyer for any reasons beyond its control, including disruption of communication lines, inoperability of communication channels through which the Buyer connects to the Seller.

9.3. The Seller shall not be liable for any losses or moral damages incurred by the Buyer as a result of an erroneous understanding or misunderstanding of information on the procedure for processing/paying for the goods.

9.4. The Buyer shall be fully liable for posting, publishing in any possible way, transmitting and distributing knowingly false messages, publications, mailings that may be criminal in nature or cause any harm to the Seller or its activities.

9.5. The Site may contain advertising mailings. The Seller shall not be liable for the content of the text, the quality of the advertised goods and (or) services.

9.6. The Site may contain links to third-party websites, plugins and applications. Clicking on these links or enabling these connections may allow third parties to collect or share data about you. The Seller does not control these third party websites and is not responsible for their privacy notices, statements or policies.

The User should independently familiarize themselves with the privacy policy of each site they visit.

9.7. The Buyer guarantees that under no circumstances will they use the purchased product for illegal purposes; for purposes that may cause harm and damage to third parties.

10. Refunds

10.1. General Provisions

10.1.1. This section governs the procedure for refunding the User's funds for paid Proxy Soxy services.

10.1.2. Refunds are made in accordance with this Offer and current legislation.

10.1.3. Given the specific nature of the services provided (providing access to digital proxy resources), refunds are only possible in cases expressly provided for in this section.

10.2. Grounds for Refund

10.2.1. The User has the right to request a refund in the following cases:

the service was not provided after payment;
the paid proxies are inoperative and cannot be replaced;
a technical error occurred with the Service, preventing the use of the Service;
other cases stipulated by applicable law.

10.2.2. If technically feasible, the Service reserves the right to first offer a proxy replacement or troubleshooting.

10.3. Refund Request Procedure

10.3.1. To process a refund, the User submits a request to the Service's support team.

10.3.2. Requests can be sent:

10.3.3. Your request must include:

order or account number;
payment date;
reason for the refund request;
payment method.

10.4. Request Review Time

10.4.1. A refund request will be reviewed by the Service within 3 (three) business days of receipt.

10.4.2. If additional technical verification is required, the review period may be extended, of which the User will be notified.

10.5. Refund Terms

10.5.1. After a refund decision is made, funds will be transferred to the User within 10 (ten) business days.

10.5.2. The actual crediting time depends on the User's bank and/or payment system.

10.6. Refund Method

10.6.1. Refunds will be made to the same payment details used for payment.

10.6.2. If a refund cannot be made using the original method, a refund may be made by another method by agreement with the User.

10.6.3. Payment system and bank fees withheld upon payment and refund may not be subject to compensation.

10.6.4. For payments processed by the Paddle payment system, a separate refund policy applies.

Users have the right to request a refund within 14 days from the date of payment.
Refunds will be issued to the same payment method that was used for the original transaction. The provisions of clause 10.6.2 of this Agreement do not apply to such payments.
Refunds for payments processed by Paddle may be handled directly by Paddle in accordance with its rules and procedures.

10.7. Refund Limitations

10.7.1. Refunds will not be issued in the following cases:

actual use of a proxy;
violation of the terms of this Offer by the User;
blocking by third-party services;
incompatibility of the service with the User's software;
other circumstances not related to the operability of the service.

The conditions of this section do not apply to payments processed by Paddle.

11. Prohibited Actions

11.1. When using the purchased product, the Seller does not approve, support, encourage or permit Buyers to use the product for the following purposes and prohibited actions.

11.2. Prohibited Activities include:

Violating general ethical or moral standards, good faith and fair conduct.
Violating any rights of third parties, including rights to property, privacy, trust, personal information, copyright, trademark, patent or any other intellectual property right or proprietary right.
Engaging in any prohibited, criminal or otherwise illegal activity, including violating information security (security, privacy).

Putting any increased risks to third parties, harmful or destructive actions, including the distribution of viruses, trojans, worms, malware and spyware, or any other similar malicious actions and products, or any other computer code, file or program that can interrupt, hijack, destroy, limit or adversely affect the functionality of any computer software, hardware, telecommunications, network equipment.
Committing hacking, fraudulent activities, cracking, distributing a virus, sabotaging the network, phishing.
Use in relation to persons under 18 years of age, and especially surveillance, accessing child pornography, distributing it, committing other activities that are capable of harming minors.
Activities that harass another person or advocate persecution.
Carrying out illegal activities, disseminating information that is misleading or false, fraudulent.
Offensive, threatening, obscene, defamatory or libelous acts and behavior.
Violating any applicable law or committing an unlawful act in any jurisdiction of actions.
Violation of this Offer.
Use of the product in violation of confidentiality, security or other damage to property, individuals and/or legal entities.
Use proxy servers to bypass websites blocked in the Russian Federation and to access websites and resources prohibited in the territory of the Russian Federation, if such actions become illegal in accordance with the legislation of the Russian Federation;

11.3. If the fact of the Buyer's performance of Prohibited Actions is revealed, the Seller will restrict access to the Service for the Buyer.

11.4. The Seller has an obligation to provide the Buyer's data and all information about Prohibited Activities upon request of competent national and foreign authorities, without sending any notifications to the User and without his consent. This applies in particular to the following cases:

In the event of any criminal or administrative investigation of the User's activities, which relate to violations of third party privacy, any other rights, as well as other types of applicable law.
In the context of compliance with or application of this Offer.
In any legal action regarding suspected illegal activities.
In compliance with legal processes or other governmental request, such as a search warrant, subpoena, statute, trial or other legal process involving the Seller.

The Seller reserves the right to make decisions regarding the implementation of internal and judicial requests, decisions that relate to violations of third party privacy or other rights, as well as other illegal use of the product.

12. Term and procedure for modification and termination

12.1. The Offer shall enter into force on the date of its posting and shall be valid indefinitely.

12.2. The Seller has the right to make changes or additions to the Offer at any time. 13. Force Majeure

13.1. The Seller shall not be liable for any full or partial failure to fulfill its obligations if the failure is due to force majeure circumstances such as fire, flood, earthquake, strikes and other natural disasters, war and military actions, failure of communication channels through which the Seller sells the goods or other circumstances beyond the control of the Parties that prevent the fulfillment of this Agreement and that arose after the conclusion of the Agreement.

13.2. If any of such circumstances directly affected the failure to fulfill the obligation within the period specified in the Agreement, then this period shall be proportionately extended by the duration of the relevant circumstance.

14. Other Conditions

14.1. The Agreement is considered concluded and comes into force at the moment of full acceptance of the terms of the Offer and is valid until the Parties fulfill their obligations.

14.2. The titles of the sections of this Offer are used for convenience only and do not affect the interpretation of the Offer or any of its integral parts.

14.3. Changes to the Public Offer and other documents facilitating the work of the Seller are made by him unilaterally without the consent of the Buyer and without his notice. The current version of the Offer is published on the Seller's Website.

14.4. The Seller is not responsible for any actions of the Buyer with the purchased goods. All purchases are made at the Buyer's own risk.

14.5. Special rules, regulations, warranties or absence thereof may be established for certain products of the Seller, which are specified before purchasing the product in the product description on the Website.

If the product has special conditions, the product description takes precedence.

14.6. If one or more provisions of the Offer are or become invalid due to changes in the current legislation of the Russian Federation, this shall not be grounds for suspending the remaining provisions of the Offer.

14.7. In everything that is not provided for by the Offer, the Parties shall be guided by the current legislation of the Russian Federation, the rules posted on the Website.

14.8. The law applicable to legal relations arising from the Offer is the law of the Russian Federation. If it is necessary to interpret the terms used in the Offer, the Parties shall be guided by the current legislation of the Russian Federation and business customs.
